Property System Inspections LLC (“Company,” “we,” “us,” or “our”) operates IrrigationCheckups.com, a software platform that helps companies manage irrigation system inspections. We are committed to protecting your privacy and handling your personal information responsibly.

This Privacy Policy explains how we collect, use, share, and protect information when you use the IrrigationCheckups platform, including our website, mobile applications, and related services (collectively, the “Service”).

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Service.

This Privacy Policy should be read together with our Terms of Service, which govern your use of the Service.

2. INFORMATION WE COLLECT

2.1 Information You Provide Directly

Account Information

When you create a Parent Account, we collect:

  • Company name
  • Company address
  • Company email address
  • Company phone number
  • Company logo (if you upload one)
  • Primary contact person’s name
  • Primary contact person’s email address
  • Primary contact person’s phone number

When you create or are added as a Team Member, we collect:

  • Your name
  • Your email address
  • Your phone number (if provided)

Payment Information

We use Stripe, a third-party payment processor, to process subscription payments. We do not directly collect or store your full credit card information. Stripe collects:

  • Credit card number
  • Expiration date
  • CVV code
  • Billing address

We receive from Stripe only limited information such as:

  • Last four digits of your credit card
  • Card type (Visa, Mastercard, etc.)
  • Expiration date
  • Payment success or failure status

Inspection Data and User Data

When you use the Service, you create and submit various types of data, including:

  • Customer names and property addresses
  • Inspection configurations and requirements
  • Inspection reports and results
  • Notes and observations
  • Custom fields and data you define
  • Any other information you choose to enter into the Service

2.2 Information Collected Automatically

Usage Information

When you use the Service, we automatically collect:

  • IP address
  • Device type and operating system
  • Browser type and version
  • Pages or features you access
  • Time and date of access
  • Time spent on pages or features
  • Referring website or source
  • Actions you take within the Service

Cookies and Similar Technologies

We use cookies and similar tracking technologies on our website homepage for advertising purposes. Cookies are small data files stored on your device. We use:

  • Advertising Cookies: We use Google Analytics to understand how visitors interact with our homepage and to measure advertising effectiveness. Google Analytics may use cookies to collect information about your browsing behavior across different websites.

You can control cookies through your browser settings. Most browsers allow you to refuse cookies or delete existing cookies. However, some features of the Service may not function properly if cookies are disabled.

GPS Location Data

If your Parent Account enables the GPS location verification feature for Team Members, we collect:

  • GPS coordinates (latitude and longitude) of the Team Member’s device during inspection activities
  • Timestamp of when location was recorded
  • Accuracy estimate of the GPS reading
  • Association between location data and specific inspection records

Important Details About Location Collection:

  • Location is collected only during active inspection activities, not continuously
  • Location is collected only if the feature is enabled by your Parent Account
  • Location data is associated with specific inspection records
  • Team Members will see a location indicator icon when this feature is enabled
  • We do not track Team Members’ locations in real-time outside of inspection activities

Images and Photos

When you capture images using the Service, we collect:

  • The image files themselves
  • Metadata embedded in images (which may include date, time, device type, and potentially GPS coordinates if your device includes this in image metadata)
  • Association between images and inspection records

2.3 Information From Third Parties

Service Providers

We may receive information about you from third-party service providers we use to operate the Service, including:

  • Authentication services
  • Email delivery services
  • Cloud storage providers
  • Analytics providers

Publicly Available Sources

We may supplement the information you provide with information from publicly available sources for purposes such as verifying business information or preventing fraud.

3. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

3.1 To Provide and Improve the Service

  • Create and manage your account
  • Process your subscription payments
  • Enable you to create, store, and manage inspection data
  • Generate inspection reports
  • Provide GPS location verification when enabled
  • Store and display images associated with inspections
  • Respond to your support requests and inquiries
  • Send you service-related notifications and updates
  • Improve and optimize the Service based on usage patterns
  • Develop new features and functionality

3.2 To Ensure Security and Prevent Fraud

  • Verify the identity of users
  • Detect and prevent fraudulent or unauthorized activity
  • Monitor compliance with our Terms of Service
  • Protect against security threats and abuse
  • Verify that inspections are performed at correct locations (through GPS data)

3.3 To Communicate With You

  • Send you important notices about your account or subscription
  • Notify you of changes to our Terms of Service or Privacy Policy
  • Send you technical notices and security alerts
  • Respond to your questions and provide customer support
  • Send you marketing communications (only if you opt in)
  • Comply with legal obligations and respond to legal requests
  • Enforce our Terms of Service
  • Protect our rights, property, and safety and the rights, property, and safety of our users and others
  • Resolve disputes and enforce agreements

3.5 For Analytics and Business Operations

  • Understand how users interact with the Service
  • Measure the effectiveness of our website and marketing
  • Conduct research and analysis to improve our business
  • Aggregate data for statistical analysis (in de-identified form)

4. HOW WE SHARE YOUR INFORMATION

We do not sell your personal information. We share your information only in the limited circumstances described below:

4.1 Service Providers and Subprocessors

We share information with third-party service providers who perform services on our behalf. These providers are contractually obligated to use your information only as necessary to provide services to us and to protect the security and confidentiality of your information.

Our service providers include:

Cloud Infrastructure and Storage:

  • WeWeb: Hosts our application
  • Google Cloud Storage: Stores inspection reports and images
  • Cloudflare: Provides content delivery network and security services
  • Xano: Backend database and API platform

Email Services:

  • Postmark: Sends transactional emails (password resets, notifications, etc.)

Payment Processing:

  • Stripe: Processes subscription payments and manages billing

Application Development:

  • WeWeb: No-code development platform used to build the application interface

AI and Document Processing:

  • Google Gemini (Google): AI-powered features (when enabled)
  • Claude (Anthropic): AI-powered features (when enabled)
  • OpenAI: AI-powered features for RAG (Retrieval Augmented Generation) functionality (when enabled)
  • CraftMyPDF: PDF generation and document processing

Analytics:

  • Google Analytics: Website analytics for our homepage

4.2 Within Your Organization

If you are part of an organization with a Parent Account:

  • Your Parent Account administrator can access all data created by Team Members under the account
  • Team Members within your organization may be able to view inspection data and reports based on permissions configured by your Parent Account administrator

We may disclose your information if required to do so by law or if we believe in good faith that such disclosure is necessary to:

  • Comply with legal obligations, court orders, or governmental requests
  • Enforce our Terms of Service or other agreements
  • Protect and defend our rights or property
  • Prevent fraud or abuse of the Service
  • Protect the personal safety of users or the public

4.4 Business Transfers

If Company is involved in a merger, acquisition, sale of assets, bankruptcy, or other business transaction, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our Service of any change in ownership or use of your information, as well as any choices you may have regarding your information.

We may share your information with third parties when we have your explicit consent to do so.

4.6 Aggregated or De-Identified Data

We may share aggregated or de-identified information that cannot reasonably be used to identify you. This information may be used for research, analytics, marketing, or other business purposes.

5. GPS LOCATION DATA

5.1 Collection and Purpose

GPS location data is collected only when:

  • Your Parent Account has enabled the location verification feature
  • You are actively performing an inspection using the mobile application
  • You have granted the mobile app permission to access your device’s location services

We collect GPS location data to:

  • Verify that inspections are performed at the correct property address
  • Prevent fraud by confirming physical presence at inspection locations
  • Provide documentation that inspections were properly conducted
  • Associate location data with specific inspection records

5.2 How Location Data Is Used

Location data is:

  • Recorded only during active inspection activities
  • Associated with specific inspection records
  • Displayed in the context of viewing inspection data
  • Not used for continuous tracking or real-time monitoring
  • Not used to create movement patterns or track Team Members outside of inspections
  • Retained as part of the permanent inspection record

5.3 Location Data Visibility

  • Parent Account administrators can view location data associated with inspections
  • Team Members can see if location verification is enabled through an indicator icon
  • Location data is viewable only in the context of specific inspection records, not as standalone tracking information

5.4 Location Data Accuracy

GPS location data accuracy depends on various factors including:

  • Device capabilities and GPS receiver quality
  • Environmental conditions (buildings, trees, weather)
  • Satellite availability and positioning
  • Device settings and permissions

We do not guarantee the accuracy of GPS location data and are not responsible for inaccuracies caused by device limitations or environmental factors.

5.5 Your Choices Regarding Location Data

  • Team Members: You can disable location services for the IrrigationCheckups app in your device settings. However, if your Parent Account requires location verification for inspections, disabling location services may prevent you from completing inspections.
  • Parent Accounts: You can enable or disable location verification for your Team Members through your account settings.

6. IMAGE DATA

6.1 Collection and Use

Images are collected only when you choose to capture them using the Service’s camera functionality. We collect images to:

  • Document inspection findings
  • Include visual evidence in inspection reports
  • Provide a record of property conditions at the time of inspection

6.2 Image Storage and Processing

Images you capture are:

  • Stored on our cloud infrastructure (Google Cloud Storage)
  • Associated with specific inspection records
  • Included in inspection reports you generate
  • Retained as part of the permanent inspection record

6.3 Image Metadata

Images may contain metadata including:

  • Date and time the image was captured
  • Device information
  • GPS coordinates (if your device automatically embeds this in images)
  • Camera settings

We do not remove metadata from images you upload. You are responsible for understanding what metadata your device includes in images and for removing any metadata you do not want to include before uploading images.

6.4 Facial Recognition and Biometric Data

We do not use facial recognition technology or analyze images for biometric data. However, images you capture may incidentally contain faces or other biometric information.

Your Responsibilities:

  • You are responsible for obtaining necessary consents before capturing images of individuals
  • You must comply with all applicable laws regarding image capture and biometric data
  • You should understand and comply with state-specific biometric privacy laws (such as Illinois BIPA, Texas CUBI, or Washington biometric laws) if you capture images containing biometric data

6.5 Third-Party Access to Images

Images are shared with:

  • CraftMyPDF for the purpose of generating PDF inspection reports
  • Other Team Members in your organization who have access to inspection records
  • Your customers if you choose to share inspection reports containing images

We do not use images for any purpose beyond providing the Service (storing them, including them in reports, and displaying them to authorized users).

7. DATA RETENTION

7.1 Active Accounts

While your subscription is active, we retain:

  • All account information
  • All inspection data, including User Data
  • All GPS location data associated with inspections
  • All images associated with inspections
  • All configuration settings and custom data

7.2 After Subscription Cancellation

When you cancel your subscription:

  • You have 30 days to export your data
  • We retain your data for an additional 6 months after cancellation
  • After 6 months, all data is permanently deleted

Data Retained for 6 Months Post-Cancellation:

  • Account information
  • All inspection records
  • GPS location data
  • Images
  • Reports
  • All User Data

This retention period allows you to reactivate your subscription without losing data and enables us to comply with legal and accounting requirements.

7.3 Immediate Deletion Requests

You may request immediate deletion of your data at any time by contacting [email protected]. Upon receiving a verified deletion request:

  • We will delete your data within 30 days
  • Some information may be retained in backups for up to 90 days
  • We may retain certain information as required by law or for legitimate business purposes (such as fraud prevention or dispute resolution)

Notwithstanding the above, we may retain certain information:

  • To comply with legal obligations
  • To resolve disputes
  • To enforce our agreements
  • To prevent fraud and abuse
  • As required for tax, accounting, or other regulatory purposes

7.5 De-Identified Data

We may retain aggregated, de-identified, or anonymized data indefinitely for analytics, research, and business purposes. This data cannot be used to identify you personally.

8. DATA SECURITY

8.1 Security Measures

We implement reasonable administrative, technical, and physical security measures to protect your information from unauthorized access, disclosure, alteration, or destruction. These measures include:

Technical Security:

  • Encryption of data in transit using SSL/TLS protocols
  • Encryption of data at rest on our servers
  • Regular security assessments and updates
  • Access controls and authentication mechanisms
  • Firewall protection and intrusion detection

Administrative Security:

  • Employee training on data privacy and security
  • Background checks for employees with access to personal information
  • Confidentiality agreements with employees and service providers
  • Incident response procedures

Physical Security:

  • Our cloud infrastructure providers (Google Cloud, Xano) maintain SOC 2 Type II compliance and implement physical security controls at their data centers

8.2 Security Limitations

Despite our security measures, no system is completely secure. We cannot guarantee absolute security of your information. You acknowledge that:

  • Internet transmission is never completely secure
  • Unauthorized third parties may unlawfully intercept or access data
  • Security breaches may occur despite reasonable precautions

8.3 Your Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • Using strong, unique passwords
  • Not sharing your login credentials with others
  • Promptly notifying us of any unauthorized access to your account
  • Keeping your contact information current so we can reach you about security matters

8.4 Data Breach Notification

In the event of a data breach that affects your personal information, we will:

  • Notify you within the timeframe required by applicable law
  • Provide information about what data was affected
  • Describe the steps we are taking to address the breach
  • Provide recommendations for steps you can take to protect yourself

9. YOUR RIGHTS AND CHOICES

9.1 Access to Your Information

You have the right to access the personal information we hold about you. You can:

  • View and update your account information through your account settings
  • Export your inspection data through the Service’s export functionality

9.2 Correction of Your Information

You have the right to correct inaccurate or incomplete personal information. You can:

  • Update your account information directly through your account settings
  • Request corrections by contacting [email protected]

9.3 Deletion of Your Information

You have the right to request deletion of your personal information, subject to certain legal exceptions. To request deletion:

  • We will process verified requests within 30 days
  • Some information may be retained as described in Section 7 (Data Retention)

9.4 Data Portability

You have the right to obtain a copy of your data in a portable format. You can:

  • Export inspection reports directly through the Service
  • Request a comprehensive data export by contacting [email protected]

We will provide data in commonly used formats such as CSV, JSON, or PDF.

9.5 Opt-Out of Marketing Communications

If we send you marketing emails (only with your consent), you can opt out by:

  • Clicking the “unsubscribe” link in any marketing email
  • Updating your email preferences in your account settings
  • Contacting [email protected]

Note: Even if you opt out of marketing emails, we will still send you transactional emails related to your account and use of the Service.

You can control cookies through your browser settings. Most browsers allow you to:

  • Block all cookies
  • Block third-party cookies only
  • Delete existing cookies
  • Receive a warning before a cookie is stored

Disabling cookies may affect your ability to use certain features of our website.

9.7 Location Services

You can control whether the IrrigationCheckups app has access to your device’s location services through your device settings. Note that if your Parent Account requires location verification, disabling location services may prevent you from completing inspections.

9.8 Exercising Your Rights

We may ask you to verify your identity before processing your request to ensure we are disclosing information only to authorized individuals.

We will respond to verified requests within the timeframes required by applicable law, typically within 30-45 days.

10. STATE-SPECIFIC PRIVACY RIGHTS

10.1 California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

Right to Know: You can request information about the categories and specific pieces of personal information we have collected, the sources from which we collected it, our purposes for collecting it, and the categories of third parties with whom we share it.

Right to Delete: You can request deletion of your personal information, subject to certain exceptions.

Right to Correct: You can request correction of inaccurate personal information.

Right to Opt-Out of Sale/Sharing: We do not sell personal information and do not share it for cross-context behavioral advertising purposes, so there is nothing to opt out of.

Right to Limit Use of Sensitive Personal Information: We do not use or disclose sensitive personal information for purposes other than providing the Service, so there is nothing to limit.

Right to Non-Discrimination: You have the right to not receive discriminatory treatment for exercising your CCPA rights.

Authorized Agent: You may designate an authorized agent to make requests on your behalf. We will require verification of both your identity and the agent’s authority.

CCPA Categories of Personal Information We Collect:

  • Identifiers (name, email, IP address, device ID)
  • Commercial information (subscription details, payment history)
  • Internet activity (usage data, browsing behavior on our homepage)
  • Geolocation data (GPS coordinates during inspections, if enabled)
  • Visual information (images captured during inspections)
  • Professional information (company name, business information)
  • Inferences (preferences, usage patterns)

10.2 Virginia, Colorado, Connecticut, Utah Residents

If you are a resident of Virginia, Colorado, Connecticut, or Utah, you have similar rights under your state’s privacy law:

  • Right to delete your personal information
  • Right to correct inaccuracies in your personal information
  • Right to opt out of targeted advertising (not applicable, as we don’t engage in this)
  • Right to opt out of sales of personal information (not applicable, as we don’t sell data)

10.3 Nevada Residents

10.4 Other States

If your state has enacted a consumer privacy law that is not specifically addressed above, we will comply with applicable requirements. Contact [email protected] to exercise your rights under your state’s privacy law.

11. CHILDREN’S PRIVACY

The Service is designed for business use by professionals and is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children under 18.

If you are under 18, do not use the Service or provide any information through the Service. If we learn that we have collected personal information from a child under 18 without verification of parental consent, we will delete that information promptly.

12. INTERNATIONAL DATA TRANSFERS

The Service is operated from the United States. All of our servers and service providers are located in the United States.

If you are accessing the Service from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States. Data protection laws in the United States may differ from those in your country of residence.

By using the Service, you consent to the transfer of your information to the United States and the processing of your information in accordance with this Privacy Policy and U.S. law.

Currently, we only serve customers within the United States and all data processing occurs within U.S. borders.

The Service may contain links to third-party websites, applications, or services that are not owned or controlled by Company. This Privacy Policy applies only to the Service.

We are not responsible for the privacy practices of third-party websites or services. We encourage you to review the privacy policies of any third-party websites or services you visit or use.

When you use third-party services through the Service (such as Stripe for payment processing), those third parties may collect information about you in accordance with their own privacy policies.

14. CHANGES TO THIS PRIVACY POLICY

14.1 Updates

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make changes, we will update the “Effective Date” at the top of this Privacy Policy and update the version number.

14.2 Notification of Material Changes

If we make material changes to this Privacy Policy, we will notify you by:

  • Sending an email to the email address associated with your account
  • Displaying a prominent notice within the Service when you next log in

14.3 Your Continued Use

Your continued use of the Service after we post changes to this Privacy Policy constitutes your acceptance of the updated Privacy Policy. If you do not agree to the updated Privacy Policy, you must stop using the Service and may cancel your subscription.

14.4 Review

We encourage you to review this Privacy Policy periodically to stay informed about how we collect, use, and protect your information.

15. DO NOT TRACK SIGNALS

Some web browsers have a “Do Not Track” (DNT) feature that signals to websites that you do not want to be tracked. Currently, there is no industry standard for how to respond to DNT signals, and we do not currently respond to DNT signals on our homepage.

However, we only use cookies on our homepage for advertising analytics through Google Analytics. You can opt out of Google Analytics tracking by using the Google Analytics Opt-out Browser Add-on: https://tools.google.com/dlpage/gaoptout

16. BUSINESS TRANSITIONS

In the event that Company undergoes a business transition such as a merger, acquisition, bankruptcy, or sale of all or a portion of its assets, your personal information may be among the assets transferred.

In such an event:

  • You will be notified via email and/or a prominent notice on our Service
  • We will inform you of any choices you may have regarding your information
  • The acquiring entity will be bound by the terms of this Privacy Policy unless they provide you with notice and an opportunity to opt out
